Terms of personal data protection

I.

Basic provision

  1. The Parties seek to implement a data processing agreement that complies with the requirements of the current legal framework in relation to data processing and with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation hereinafter referred to as the “GDPR). The administrator of the personal is BIM 4G s.r.o. IČ 08479038 with its registered office at Helštýn 689, 744 01 Frenštát pod Radhoštěm, entered in the Commercial Register kept at the Regional Court in Ostrava, under file number C 85514 / KSOS entered in the Trade Register kept in Prague. (hereinafter referred to as the “Administrator“).

  1. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as name, identification number, location data, network identifier or one or more specific elements social identity of that natural person.

  2. The administrator did not appoint a data protection officer.

II.

Sources and categories of personal data processed

  1. The administrator processes the personal data that you provide him when you subscribe to the newsletter or create an order:

  • name and surname

  • email address

  • phone

  1. The administrator processes the personal data you provided him when registering in the application:

  • name and surname

  • email address

  1. The administrator processes the identification and contact data of you and other partners provided during the order and the data necessary for the performance of the contract:

  • name and surname

  • email address

  • company billing information

III.

Legal reason and purpose of personal data processing

  1. The legal reason for processing personal data is:

  • performance of the contract between you and the administrator pursuant to Article 6, paragraph 1, letter b) GDPR,

  • fulfillment of the legal obligation of the administrator pursuant to Article 6, paragraph 1, letter c) GDPR,

  • the legitimate interest of the administrator in the provision of direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6 (1) (a) f) GDPR,

  • your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6 (1) (a) a) GDPR in connection with § 7 paragraph 2 of Act No. 480/2004 Coll., on certain information society services in the event that no goods or services have been ordered.

  1. The purpose of personal data processing is:

  • control access to the Forgee Budget application,

  • settlement of your order and exercise of rights and obligations arising from the contractual relationship between you and the administrator; when ordering, personal data are required, which are necessary for successful execution of the order (name and address, contact), provision of personal data is a necessary requirement for concluding and fulfilling the contract, without providing personal data it is not possible to conclude the contract or perform it,

  • fulfillment of legal obligations towards the state,

  • sending business messages and doing other marketing activities.

  1. The administrator has an automatic individual decision-making within the meaning of Article 22 of the GDPR. You have given your express consent to such processing.

IV.

Data retention period

  1. The administrator stores personal data

  • for the time necessary to exercise the rights and obligations arising from the contractual relationship between you and the administrator and to assert claims under these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

  • until the consent to the processing of personal data for marketing purposes is revoked, for a maximum of 5 years, if the personal data are processed on the basis of the consent.

  1. After the retention period of personal data, the administrator deletes the personal data.

V.

Recipients of personal data (subcontractors of the administrator)

  1. The recipients of personal data are persons:

  • involved in the supply of goods / services / execution of payments on the basis of a contract.

  • accounting company for the creation of documents, their accounting and tax control (FIKU s.r.o.).

VI.

Processors of personal data

  1. The processing of personal data is performed by the administrator, but the following processors may also process personal data for him:

  • Agile CRM service provider,

  • Google Drive Provider,

  • Atlas MongoDB service provider,

  • AWS service provider,

  • WordPress service provider,

  • or another provider of processing software services and applications, which, however, are not currently used by the administrator.

  1. The controller intends to transfer personal data to a third country (to a non-EU country) or to an international organization. Personal data processors in third countries are cloud service providers.

VII.

Your rights

  1. Under the conditions set out in the GDPR, you have

  • the right of access to their personal data pursuant to Article 15 of the GDPR,

  • the right to correct personal data pursuant to Article 16 of the GDPR, or restrictions on processing pursuant to Article 18 of the GDPR,

  • the right to delete personal data pursuant to Article 17 of the GDPR,

  • the right to object to the processing pursuant to Article 21 of the GDPR,

  • the right to data portability under Article 20 of the GDPR a

  • the right to withdraw the consent of data processing in writing or electronically to the address or e-mail of the administrator specified in Article III of these conditions.

  1. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to go to court.

VIII.

Terms of personal data security

  1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

  2. The administrator has taken technical measures to secure the data repositories.

  3. The controller declares that only persons authorized by him have access to personal data.

IX.

Final Provisions

  1. By logging in to the application, you confirm that you are familiar with the conditions of personal data protection and that you accept them in full.

  2. You agree to these conditions by sending an online form or by sending an email to the administrator’s email address. By sending an email / form, you confirm that you are familiar with the conditions of personal data protection and that you accept them in full.

  3. The administrator is entitled to change these conditions. They will publish a new version of the terms of personal data protection on their website.

These conditions take effect on 1.1.2021.
